Article 1. the game
"Runner" is a game (the "Game") with no money involved, organized in the name of and on behalf of the Affiliated companies listed in Appendix 2 (said Affiliated companies being hereinafter collectively referred to as the "Organizers" and individually as the "Organizer"), by TotalEnergies Marketing Afrique, a simplified joint stock company whose registered office is located at 24 Cour Michelet, 92800 Puteaux (France), registered under number 542 038 716 (RCS NANTERRE), acting in the name of and on behalf of the Organizers.
The Game is available on the website of each Game Organizer.
The Game is operated by the Organizers within their respective countries of registration (hereinafter the "Participating Countries", as listed in Appendix 1 of these Rules), under their exclusive responsibility within said countries.
For the purposes of these Rules, the term "Affiliate" refers, in relation to TotalEnergies SE, to all companies which, directly or indirectly, are Controlled by TotalEnergies SE (the term "Control" meaning the direct or indirect holding of more than 50% of the voting rights; the terms "Controlled", "Controlling" and "Controlling" being interpreted accordingly).
The purpose of these rules (hereinafter referred to as the "Rules"), consisting of this document and its appendices, is to define the terms and conditions for participation in the Game and the terms and conditions for the running of the Game.
Description and features
In this racing game, participants have to clear a path to survive as long as possible. They'll have to jump and slide to avoid obstacles and collect bonuses. The aim is to achieve the highest score.
Article 2 Organisation
2.1 Each Organizer organizes the Game in its own name and on its own behalf in the Participating Country concerned. There is no solidarity between the Organizers of the different Participating Countries.
2.2 The Game is open to all visitors to the website (the "Site") of one of the Organizers.
2.3 Within each of the Participating Countries, the Organizer registered in the Participating Country is solely responsible with regard to players who have played on the Site of the Organizer concerned.
Article 3. Conditions of access to the Game
Participation in the Game is open to all natural persons of legal age at the time of entry, residing in one of the Participating Countries and having Internet access at that time, as well as an account in their name on the Site and an e-mail address at which they may, if necessary, be contacted for the purposes of managing the Game (hereinafter the "Participant").
Persons under the age of majority at the time of entry (depending on the player's nationality) are excluded from participation in the Game.
Article 4. How to register and take part in the Game
To take part in the Game, the Participant must visit the Site of one of the Organizers.
Participation in the Contest may only be made in the manner described above. Participation in any other form or by any other means will not be taken into account.
Any person wishing to participate in the Contest must provide the Organizer with the following personal information (hereinafter referred to as "Personal Information"):
The Personal Information provided by the Participant must be valid and sincere, failing which the Participant will be excluded from the Game.
Article 5. Compliance with participation conditions
Participation in the Game implies unreserved acceptance of the Rules in their entirety.
The Organizer reserves the right to verify the accuracy of the data provided by Participants. Failure to comply with the conditions of participation set out in the Rules and, more generally, any inaccurate or misleading statement, or any fraud, will result in the Participant's disqualification. No telephone or written request concerning the interpretation or application of the Rules, the mechanisms or the terms and conditions of the game will be answered.
The Organizer may, as of right and without prior notice, exclude any Participant who has not complied with the Rules.
It is strictly forbidden for a Participant to play with several e-mail addresses, or to play from a player account opened for another person.
It is strictly forbidden, by any means whatsoever, to modify or attempt to modify the Game mechanisms, in particular in order to modify the results.
Article 6. Use of Participants' personal data
6.1 - Data collection
Personal data, including Personal Information, collected when registering for the Game (hereinafter referred to as "Personal Data") are processed by Total Marketing Services, as a subcontractor of the Organizer, which is responsible for processing, for the purposes of running the Game and managing Participants' rankings.
Personal Data will also be processed by the Organizer for commercial prospecting purposes (sending of communications or commercial offers) subject to the Participants' consent. Each Participant may withdraw his or her consent to receive such communications and commercial offers at any time by following the instructions provided in each message. The collection and processing of Personal Data is carried out by the Organizer in accordance with the law of its country of registration.
6.2 - Data recipient
The Personal Data collected from Participants may be communicated to the Organizer, to certain departments of the Organizer as well as to IT service providers and subcontractors acting on behalf of the Organizer solely for the performance of their missions carried out as part of the organization and smooth running of the Game.
The Organizer may transmit the Personal Data collected in the event of receipt of a request from a judicial authority or any administrative authority empowered by law requesting the communication of such Personal Data, in accordance with the legal and regulatory provisions in force applicable in the country where the form was submitted.
6.3 - Data transfer
Any transfer of Personal Data to a third country outside the European Economic Area is carried out in compliance with the applicable regulations and in such a way as to ensure adequate data protection.
In order to ensure adequate protection of Personal Data originating from the European Economic Area that may be transferred to TotalEnergies entities established outside the European Economic Area, "Binding Corporate Rules" (BCR) have been adopted. For transfers of Personal Data not covered by the BCR and made to countries outside the European Economic Area, other measures are put in place to ensure adequate protection of Personal Data. 6.4- Security and confidentiality of Personal Data
The Organizer implements appropriate measures to preserve the security and confidentiality of Personal Data and, in particular, to prevent it from being deformed, damaged or accessed by unauthorized third parties in compliance with applicable laws and regulations.
6.5 - Retention of Personal Data
6.6 - Participants' rights
In accordance with current regulations, Participants have the right to access, rectify and delete their Personal Data, and may also request that the processing be limited. Participants also have a right to portability and may object to processing, including for commercial prospecting purposes. Participants may also withdraw their consent at any time where processing is based on this legal basis.
To exercise their rights or request information about the processing of their Personal Data, Participants may send a request to the address given in the personal data charter on the Organizer's Site.
If, after contacting the Organizer, Participants consider that their rights have not been respected, they may submit a complaint to the competent supervisory authority.
Article 7. Intellectual property - Image rights
7.1 - All names or trademarks mentioned in these Rules, as well as on any communication media relating to the Game, remain the exclusive property of their author or registrant.
7.2 - The images used on the Site, the objects represented, the trademarks and trade names mentioned, the graphic and computer elements and the databases making up the Site (hereinafter together "Site Elements"), are the exclusive property of their respective owners and may not be extracted, reproduced or used without the written authorization of the latter, on pain of civil and/or criminal prosecution.
7.3 - The reproduction, representation or use of all or part of the Site Elements by the winner without the prior authorization of the Organizer is strictly prohibited.
7.4 - Any resemblance of characters or elements of the Game with other fictitious characters or other elements already in existence is purely fortuitous and may not give rise to liability on the part of the Organizer or its service providers.
Article 8. Modification, suspension or cancellation
The Organizer cannot be held responsible if, in the event of force majeure or events beyond its control (notably technical problems) disrupting the organization and management of the Game, the Game is cancelled, postponed, suspended or modified. For the purposes of these Rules, force majeure is defined as any unforeseen, insurmountable event beyond a person's control likely to relieve them of their responsibility or release them from their commitments.
The Organizer reserves the right to:
Any modification will be the subject of an amendment to the Rules published on the Site. Any amendment will come into force as soon as it is published.
The Participant is deemed to have accepted these amendments simply by participating in the Game from the date on which the amendment comes into force, and expressly waives any claim or dispute relating to any amendment made to the Rules by the Organizer.
The Organizer may cancel all or part of the Contest if it appears that fraud has been committed in any form whatsoever, particularly by computer, in connection with participation in the Contest.
Article 9. Responsability
The Organizer may not be held liable for any prejudice of any kind (personal, physical, material, financial or other) arising from a Participant's participation in the Game. Participation in the Game implies acceptance by the Participant of this condition. No claim will be accepted in this respect.
Participants are expressly reminded that the Internet is not a secure network. In this respect, participation in the Game implies knowledge and acceptance, by all Participants, of the characteristics and limits of the Internet, particularly with regard to technical performance, response times for consulting, querying or transferring information, the risks of interruption, and more generally, the risks inherent in any connection and transmission on the Internet, the lack of protection of certain data against possible misappropriation and the risks of contamination by any viruses on the Internet network.
As a result, the Organizer cannot be held responsible for contamination by viruses or for the intrusion of a third party into the terminal system of Participants in the Game, and declines all responsibility for the consequences of Participants' connection to the network via the Site.
In particular, the Organizer may not be held liable for any damage caused to Participants, their computer equipment and the data stored on it, or for any consequences that may arise from this for their personal or professional activity. It is the responsibility of all Participants to take all appropriate measures to protect their own data and/or software stored on their computer equipment against any attack. Any person connecting to the Site and taking part in the Game does so under their own responsibility.
In addition, the Organizer may not be held liable in the event of malfunction of the Internet network, or any problem related to, but not limited to:
The Organizer may not be held liable for any damage caused by Participants to third parties or to the rights of third parties.
Given the characteristics of the Internet network, such as the free capture of information and the difficulty, or even impossibility, of controlling the use that may be made of it by third parties without the Organizer's knowledge, the Organizer cannot be held responsible for any fraudulent use of connection rights unless it can be shown to have been guilty of gross negligence.
In general, the Organizer may cancel all or part of the Contest if it appears that fraud has occurred in any form whatsoever, in particular computer fraud in connection with participation in the Contest. However, the Organizer shall not be held liable in any way whatsoever to Participants for any fraud that may have been committed.
The Organizer will use its best efforts to provide access to the Game on the Site at all times, without being under any obligation to do so.
The Organizer may, at any time, in particular for technical reasons or reasons of updating or maintenance, interrupt access to the Site. The Organizer shall in no event be liable for such interruptions or their consequences.
The Organizer shall in no event be held liable if the Personal Data relating to a Participant's registration (i) do not reach the Organizer for any reason for which the Organizer cannot be held responsible, such as, but not limited to, an Internet connection problem due to any reason whatsoever on the part of the Participant, or a temporary Internet server failure, or (ii) reach the Organizer illegible, or (iii) are impossible to process due, but not limited to, the Participant's computer hardware or software environment being unsuitable for registration.
Under no circumstances shall the Organizer be held responsible for any loss of data or deterioration of the Participant's Personal Data.
Any complaint relating to the application of the Rules or their interpretation must be addressed in writing to the Organizer's contact, indicated in Appendix 2.
However, the Organizer reserves the right not to take action on any complaint it deems irrelevant.
Article 11. Proof agreement
It is agreed that, except in the case of manifest error, the Organizer may rely, in particular for purposes of proof, of any act, fact or omission, on programs, data, files, recordings, operations and other elements (such as monitoring reports or other statements) of any kind or in computer or electronic formats or media, established, gathered or stored directly or indirectly by it, in particular in its information systems.
Thus, the elements considered constitute proof and, if they are produced as means of proof by the Organizer in any contentious or other proceedings, they will be admissible, valid and opposable between the parties in the same way, under the same conditions and with the same probative force as any document that would be established, assembled or kept in writing.
Article 12. Ethics
The Organizer reiterates its commitment to respecting the rules on the fight against corruption, fraud and infringement of competition law, and expects each Participant to respect this same commitment.
In addition, each Participant undertakes to declare any potential conflict of interest that may arise during his or her participation in the Game, in particular in relation to the existence of any family, professional or other relationship that could give rise to suspicion regarding his or her participation.
Article 13. Independence
Registration and participation in the Game does not in any way create a subordinate relationship between the Organizer and the Participant.
Article 14. Applicable law - Jurisdiction
The present Rules are subject exclusively to the law of the Participating Country in which the Organizer is registered, to the exclusion of the principles of conflict of laws.
Any dispute arising in connection with the Game shall be submitted to the competent courts, having regard to the nature of the dispute, of the city in which the Organizer is registered, as specified in Appendix 2.
Article 15. Completeness - Nullity
Should one of the clauses of the Regulations become null and void as a result of a change in legislation or regulations or by a court decision, this shall in no way affect the validity of and compliance with the other clauses of the Regulations.
